Governor Jim Pillen signed the order in 2023, prompting the Nebraska Association of Public Employees (NAPE) to seek bargaining over the policy change. The State Commission on Industrial Relations and the Nebraska Supreme Court both sided with the state, citing language in the existing labor contract. However, the court did reverse a decision that found the state employee union acted in bad faith when challenging the policy change.
